This excursion is promoted by Excursions By Rail Limited, company number 13364100, a wholly owned subsidiary of Holmes Purdham Group Limited, company number 15871995 (“the promoter”).
The train is operated by a licensed charter operator appointed by the promoter (“the train operator”).
On-board catering is provided by a specialist third-party contractor (“the caterer”).
Together, these organisations are referred to as “we/us”.
By purchasing a ticket, you (“the passenger”) agree to the following Terms & Conditions.
1. Booking, Payment & Ticketing
- All seats must be booked and paid for in advance, and all seats are fully reserved.
- Tickets are STRICTLY non-refundable and non-transferable under all circumstances.
- The promoter accepts no liability for booking errors made by the passenger or a third-party retailer.
- Seating requests will be considered but cannot be guaranteed.
2. Third-Party Retailers
- Tickets may be available through approved third-party retailers.
- Regardless of the place of purchase, these Terms & Conditions apply in full.
- The promoter cannot amend, refund or correct bookings made via third-party retailers — all such queries must be directed to the retailer.
- The promoter is not responsible for the retailer’s communication, ticket issuing or administrative practices.
3. Refund Protection (XCover)
- Passengers may purchase optional Refund Protection at checkout, administered independently by XCover.
- All refund claims must be submitted directly to XCover, whose decision is final.
- The promoter, the train operator, the caterer and all third-party retailers cannot issue refunds under any circumstances.
- Passengers who decline Refund Protection accept full liability should they be unable to travel for any reason.
4. Train Service & Operational Variations
- We will make every reasonable effort to operate the excursion as advertised; however, we reserve the right to amend:
- The route
- Timings
- Rolling stock, locomotives, or carriage layouts
- Operational arrangements
Such changes do not entitle passengers to a refund.
Railway operating conditions, safety requirements, network restrictions or rolling-stock availability may necessitate alterations at short notice.
5. Timings
- Provisional timings are indicative only.
- Final confirmed joining instructions and timings will be sent to passengers no later than 14 days prior to the date of departure.
- Passengers are responsible for ensuring that the email address provided at booking is correct and monitored.
- Failure to receive or read the final timings does not entitle the passenger to a refund.
- Passengers must arrive at their joining station in good time.
- Missed trains cannot be refunded, regardless of the cause.
6. Liability for Missed Connections
We accept no liability for missed onward travel, accommodation, connecting services, or any other consequential losses arising from delays or operational changes.
7. Cancellation by the Promoter
- If the excursion is cancelled entirely, passengers will receive a refund of the ticket price only.
- Refund Protection premiums are non-refundable.
- We are not liable for any costs beyond the ticket price, including accommodation or travel expenses.
8. Catering & Food Service
- All catering is provided by an independent third-party caterer appointed by the promoter.
- Food preparation, storage and service remain under the caterer’s exclusive control.
- Menu descriptions are provided in good faith but may vary due to supply, availability or operational constraints.
- The promoter reserves the right to amend menus, dishes or ingredients at any time without prior notice.
- No refunds or compensation will be offered for menu changes or variations.
9. Menu Selection & Pre-Order Requirements
- Passengers in dining classes must submit/pre-select menu choices by the deadline issued in their joining instructions.
- Failure to submit choices by the deadline may result in:
- A default meal being allocated
- Limited choice on the day
- Receiving whichever dishes are available
Menu choices cannot be changed after the published cut-off date.
No refund or compensation will be offered for unsubmitted or incorrect menu choices.
10. Allergies & Dietary Requirements
- Passengers must disclose all allergies, intolerances and dietary requirements at the time of booking or immediately afterwards.
- While reasonable efforts will be made, we cannot guarantee the absence of allergens, including nuts, gluten, dairy, soy, eggs or others.
- Charter train galleys and heritage rolling stock are not allergen-free environments.
- Cross-contamination may occur.
- Passengers with severe allergies or anaphylaxis travel entirely at their own risk.
- The promoter, train operator and caterer accept no liability for allergic reactions or allergen exposure, however caused.
11. On-Board Conduct
- We reserve the right to refuse boarding or remove passengers whose behaviour:
- Threatens safety
- Causes nuisance or discomfort
- Shows signs of intoxication
- Fails to comply with staff instructions
No refund will be provided if a passenger is refused travel or removed.
12. Accessibility
- Due to the use of heritage rolling stock, full accessibility cannot be guaranteed.
- Passengers with mobility or medical needs must contact the promoter before booking.
13. Prohibited Items
- Pets (other than registered assistance dogs) and bicycles are not permitted.
- Smoking and vaping are prohibited on the train and stations.
14. Complaints Process
- If a problem arises during the excursion, it must be brought immediately to the attention of a member of Excursions By Rail staff.
- Complaints will not be considered unless a concern was raised on the day, giving staff the opportunity to resolve the matter.
- Post-travel complaints must be submitted to customers@excursionsbyrail.co.uk within 10 days of travel.
15. Force Majeure
We shall not be liable for delays, alterations, curtailments or non-performance caused by circumstances beyond our reasonable control, including but not limited to: severe weather, mechanical failure, accidents, industrial action, staff illness, emergency railway restrictions or security incidents.
16. Entire Agreement
These Terms & Conditions constitute the entire agreement.
No member of staff, contractor or retailer may vary or override them.
17. Customer Cancellation or Alteration
- Tickets are strictly non-refundable and non-transferable.
- Resale, exchange, alteration, deferral, or name changes are not permitted.
- Refund Protection (XCover) is the only mechanism that may offer a refund in limited circumstances.
18. Governing Law
These Terms & Conditions are governed by the laws of England & Wales.
Any disputes shall be subject to the exclusive jurisdiction of the English courts.
